An Act providing for boating safety training. Be it enacted by the Senate and House of Representatives in General Court assembled, and by the authority of the same, as follows: Section 3 of chapter 90B of the General Laws, as appearing in the 2008 Official Edition, is hereby amended by inserting after the word “him”, in line 3, the following words:- ;provided, however, that when filing such application, there shall be attached a safe boating education certificate stating that said applicant has passed a boater safety course; provided, further, that said certificate shall include that the operation of said vessel shall include: (i) all vessels having over 25 horsepower; and (ii) ski crafts less than 13 feet that is capable of reaching over 20 miles per hour and has the capacity to carry no more than an operator and one other person may be operated only by persons who are 16 years old or older and who have a valid state boater education certificate. Such certificate shall be issued by another state agency and NASBLA approved; by the United States Power Squadron; the United States Coast Guard; and by the commonwealth of Massachusetts to persons under the age of 16, only if he or she is accompanied by a person 18 years of age or older who also has such certificate. |
